When it first began operating services, a major UK light rail system in the north of England was owned and operated by private transport firms under a 10-year operating and maintenance (O&M) contact. Four companies were shortlisted to tender for the subsequent seven-year O&M contract.
Following contract award, Direx Solutions was instructed by an international law firm to perform the role of expert witness following a challenge by one of the unsuccessful bidders to the client’s final decision. The expert report reviewed the tender process and included an independent assessment of evaluation criteria, the bid evaluation process and scores awarded.
The case was settled out of court by the disputing parties.
